Surveys various authorities governing immigration detainers, which are documents that advise other Federal, State, and local law enforcement agencies that DHS and ICE seek custody of an alien whom they are holding in order to arrest and remove the alien. Discusses key legal issues raised by immigration detainers, including whether DHS detainer regulations and practices are beyond its statutory authority, whether States and localities are required to comply with immigration detainers, who has custody of aliens subject to detainers, and whether detainer practices violate constitutional rights of aliens.
